Najib Razak’s Conviction and Legal Challenges: A Deep Dive into the SRC International Case

Najib Razak, the former Prime Minister of Malaysia, has been embroiled in a complex legal battle stemming from his involvement in the SRC International scandal, a subsidiary of the beleaguered state investment fund 1Malaysia Development Berhad (1MDB). The scandal, which involved the misappropriation of millions of dollars, rocked the nation and contributed to the downfall of Najib’s Barisan Nasional coalition in the 2018 general elections. At the heart of the case is the accusation that Najib siphoned RM42 million from SRC International into his personal bank accounts between 2014 and 2015. This act led to charges of criminal breach of trust, money laundering, and abuse of power, ultimately culminating in his conviction and sentencing.

In July 2020, the High Court delivered a guilty verdict on all seven counts against Najib. He was sentenced to 12 years in prison and slapped with a hefty RM210 million fine. Before leaving office in January 2022, the then-King of Malaysia commuted Najib’s sentence, halving his jail term to six years and reducing his fine to RM50 million. One such attempt involved submitting affidavits from high-ranking political figures, including Deputy Prime Minister Ahmad Zahid Hamidi, claiming they had seen a royal order related to the case. However, this strategy backfired when the High Court, in July 2023, dismissed the affidavits as inadmissible hearsay evidence. Judge Amarjeet Singh ruled that the government had no legal obligation to respond to the application based on unsubstantiated claims. This ruling underscored the court’s commitment to upholding legal procedures and relying on credible evidence.

The SRC International case is not an isolated incident in Najib’s legal woes. He faces multiple other charges related to the broader 1MDB scandal, which involved billions of dollars allegedly misappropriated from the fund. These ongoing legal battles continue to cast a long shadow over Najib’s political career and highlight the pervasive nature of corruption within Malaysian politics. The complexity of the 1MDB scandal, with its international reach and intricate financial transactions, presents a significant challenge for investigators and prosecutors. Unraveling the web of financial dealings and holding all those responsible accountable remains a priority for the Malaysian government.

The ramifications of the SRC International case and the larger 1MDB scandal extend beyond Najib’s individual fate.
