Special counsel for the DOJ argues against dismissal of Hunter Biden’s indictment

Attorneys for Hunter Biden have filed a motion to dismiss the grand jury indictment against him, arguing that the charges should be wiped away since President Biden pardoned his son. However, Special Counsel David Weiss has filed a request to deny the dismissal, stating that the charges were based on probable cause and should not be dismissed simply because of the pardon. The special counsel also noted that no court has agreed with Hunter Biden’s claims of selective prosecution, and he requested that the indictment be upheld.

President Biden pardoned his son Hunter, stating that the charges against him for illegally purchasing a gun and failing to pay $1.4 million in taxes were politically motivated and a miscarriage of justice. Hunter Biden was found guilty in the gun case in June, with a jury determining that he made false statements related to the purchase of a gun and possessing a gun while being an unlawful user of a controlled substance. He has a well-documented history of drug abuse, which he detailed in his memoir, “Beautiful Things,” where he discussed his addiction to crack cocaine and interactions with drug dealers.

In response to the special counsel’s request to deny the motion to dismiss the indictment, Hunter Biden’s attorney argued that the majority of courts have supported dismissal when faced with a similar situation. The defense team claimed that the special counsel’s argument lacks legal support and pointed to the practice of courts dismissing indictments in similar circumstances. Despite the pardon from President Biden, the special counsel is seeking to uphold the charges against Hunter Biden based on the grand jury’s findings of probable cause.

Hunter Biden also faced charges in a tax case, where he was set to stand trial for felony and misdemeanor tax offenses related to failing to pay $1.4 million in taxes. Prior to jury selection in September, Hunter entered a surprise guilty plea in the tax case. The charges against Hunter Biden have been met with controversy, with the president alleging that they were politically motivated and a miscarriage of justice. The legal battle surrounding Hunter Biden’s indictment continues to unfold as both the defense and the special counsel argue their respective positions.

In light of the legal developments, it remains unclear whether the grand jury indictment against Hunter Biden will be dismissed or upheld. The president’s pardon of his son has sparked debate over the validity of the charges and the motives behind the prosecution. With both the defense and the special counsel presenting their arguments to the court, the outcome of the case will ultimately be decided by the judge presiding over the matter. The legal saga surrounding Hunter Biden’s indictment, pardon, and the subsequent motions filed by both parties highlights the complexities of the legal system and the ongoing debate over justice and accountability.
